01Why

How crypto is taxed in India

  1. Gains on virtual digital assets, including USDT, are taxed at a flat 30% plus 4% cess, whatever your income slab or holding period. Surcharge may also apply on high incomes.
  2. Only the cost of buying the asset can be deducted. Fees and other expenses can't.
  3. Losses can't be set off against other income or other crypto gains, and can't be carried forward.
  4. 1% TDS applies to the sale value once yearly payments cross ₹50,000 for specified persons (₹10,000 for others). It's an advance tax you claim back in your return; on P2P the buyer is responsible for deducting it.

Example with today's price: buying 1,000 USDT at ₹104.99 and selling at ₹108.14 gives a gain of ₹3,150. Tax plus cess is ₹983, and ₹1,081 is deducted as TDS on the sale.

Estimate only, for individuals; it does not include surcharge or your other income. This is not tax advice. Rules can change in each Union Budget, so check with a chartered accountant.

02FAQ

USDT to INR: frequently asked questions

How much tax do I pay on crypto in India?

A flat 30% on the gain, plus 4% cess (31.2% in total before any surcharge), whatever your income slab.

Is TDS on crypto an extra tax?

No. The 1% TDS is an advance payment. It appears in Form 26AS/AIS and you claim it against your final tax, or get it refunded, when you file your return.

Can I offset crypto losses?

No. Losses from crypto can't be set off against salary, business income or other crypto gains, and can't be carried forward to later years.

Do I pay tax on USDT if its price barely moves?

Yes, on any gain in rupees. USDT's INR price moves with the P2P market, so buying low and selling high creates a taxable gain even though USDT tracks the dollar.
